Agritourism in NSW

Effective 1 December 2022 The NSW government is making changes to planning rules to make it easier for farmers to use their land for agritourism activities such as farm experiences, cellar doors and farm stay accommodation.

What is Agritoursim?

Agritourism is a tourism-related experience or product that connects agricultural products, people or places, with visitors to a farm and includes:

Farm gate premises – where visitors interact with produce from the farm, such as fruit picking, sales, tastings, workshops and cafes.
Farm experience premises – where visitors can experience life on a farm including tours, horse riding, weddings, functions and retreats.
Farm stay accommodation – where visitors can stay in buildings or moveable dwellings, including tents and caravans, on a farm.

The new planning rules

The aim of these planning rules is to remove some of the red tape experienced by farmers who want to open a new income stream. Under the new planning rules there will be :

Exempt development which is minor and low-impact development that can be carried out without the need for planning or building approval if it meets specified development standards.
Complying development which allows for fast-tracked approval process for straight-forward development where planning and building standards can be signed-off by the council or a registered certifier.

Now there are various rules you need to comply with for each type of farm experience. But for there are numerous ways you could create farm experience without needing any approval from another party. In effect no red tape.
