Don’t lose JobKeeper for August and September if you are not meeting the “one in all in, rule”

Many businesses would be aware of the recent announced extension to JobKeeper from October 2020 to March 2021.

But as part of this extension, the government changed the rules as they apply to August and September.  For fortnights starting 3 August 2020, the relevant date of employment for assessing which employees were eligible for the JobKeeper payment is now 1 July 2020.  This was previously 1 March 2020.

This means that if you:

  • Employed new staff between 1 March and 1 July they may now be eligible for JobKeeper
  • If you had a casual who you are still using who may not have had 12 months as at 1 March, they may be eligible now.
  • If you had someone who has turned 18 between 1 March and 1 July, they may be eligible.

Now if you have any of these newly eligible employees but don’t pay them the minimum $1,500 per fortnight under the JobKeeper, you may lose JobKeeper for all your employees, under the ATO’s “one in all in, rule”.

Under this rule, unless everyone who is eligible gets paid the minimum $1,500 per fortnight, and you claim JobKeeper for everyone, the ATO has the ability to reject your whole JobKeeper claim.

Make sure for your staff, one in all in and don’t get caught short and lose your JobKeeper payment.
